Requirements

  • Under Local Policy BBB the next trustee election is in May of 2023. Therefore, the deadline (the 90th day before the date of the first regular school board election) for which the board shall redivide the district would be in February 2023 (February 5, 2023).  However, it is preferable that this is accomplished much earlier such as by December 2022.

    In redrawing the lines of single-member districts, the single member district must be compact and contiguous (attached to another single-member district) and must be as nearly as practicable of equal population:

    If single-member trustee districts are adopted or approved as provided by this section, the board shall divide the school district into the appropriate number of trustee districts, based on the number of members of the board that are to be elected from single-member trustee districts, and shall number each trustee district.  The trustee districts must be compact and contiguous and must be as nearly as practicable of equal population.  In a district with 150,000 or more students in average daily attendance, the boundary of a trustee district may not cross a county election precinct boundary except at a point at which the boundary of the school district crosses the county election precinct boundary.  Trustee districts must be drawn not later than the 90th day before the date of the first election of trustees from those districts.  Texas Education Code 11.052 (f).

    The only other requirements are that the Board take the required action in a properly posted meeting by the deadline and notify the County Elections Administrator.  In addition, any changes to existing single-member districts must comply with Section 2 of the Voting Rights Act that prohibits voting practices or procedures that discriminate on the basis of race, color, or membership in one of the language minority groups. In previous census years including 2010, the United States Department of Justice required pre-clearance, which mandated numerous other requirements. Now pre-clearance is no longer required.
