What is Due Process
Due Process is the notice and opportunity to be heard. The elements of notice are not limited to just notice of the charge against a person at the time of the due process hearing, but notice of the prohibited conduct and the subsequent punishment prior to the offense occurring. The school district provides its students with this notice via the Student Code of Conduct The amount of due process a student is entitled to is dependent upon the degree of deprivation ( i. e., a student receives more due process for an expulsion than a three-day suspension).
